Horrific moment thug, 26, kicks man’s head ‘like a FOOTBALL’ during brutal attack while on early-release from prison – as he’s jailed for three years

A violent yob who kicked a young man in the head ‘like a football’ has been jailed for three years and nine months.

Horrific photos show Josh Marshall attacking Ciaran Flynn in a car park in East Kilbridge, Scotland, back in June.

The 26-year-old left his victim with permanent disfigurement and permanent impairment.

Mr Flynn, 28, needed to have dental treatment, surgery and was unable to eat after the attack.

Marshall (above) has been sentenced for three years and nine months after assaulted Mr Flynn 

Hamilton Sheriff Court heard that father-of-one Marshall, had assaulted Mr Flynn after being given early release from prison.

The Daily Record reported that Sheriff Shiona Waldron told Marshall that he would be given a shorter sentence due to his guilty plea.

She said: ‘You have an appalling record for violence. I would have sentenced you to five years given that record and the nature of this assault, but I’ll reduce that because of your early guilty plea.’

The attack was captured by a resident in East Kilbridge and one resident said it had been ‘horrific to witness’.

They said the situation turned from people joking, to an assault and that Mr Flynn had been ‘being kicked in the temple’.

They added: ‘His head was being kicked about like it was a football – he could have easily been killed.

‘There is absolutely no way the sentence fits the crime. He should have been given longer in jail.’

Speaking to East Kilbridge News the witness added that they called the emergency services straight away and ran out as soon as they could.

Police then arrived and Mr Flynn was said to have been asking for his mother.

There had been no indication that Marshall knew of his victim before the attack and prosecutor Scott King revealed footage of the beating to the court room.

Officers found Mr Flynn in the car park, with blood coming from his mouth. He had been very confused and was unable to remember what had happed

Mr King said: ‘The officers saw the mobile phone footage, recognised the accused as the man who’d spoken to them and arrested him a short time later.’

The court heard how Mr Flynn now has to keep a soft diet, as he can no longer open his mouth fully, but that this could improve with time.

Elaine Rae, defending said that Mr Marshall had been drinking since 10am on the day of the attack.

‘That does not excuse his senseless violence. He was shocked when he saw the footage and wishes to apologise to the victim.’
